Who are we?

Placing an order
If you place an order through our website you will be bound by the following Terms and Conditions (these Terms). In these Terms references to our or we or equivalent language refers to Our Bakery Limited trading as the Town Mill Bakery.
Because of the nature of what we do, our pricing and availability of our products can change without prior notice and if pricing or availability does change we will let you know after you submit your order. If we have not changed our prices and the goods are available, we will accept your order as soon as we receive it and at that point we will make a contract with you to provide you with the products you have ordered. Your credit or debit card will then be charged.
If someone will not be available to take delivery of your order during the day, please specify instructions for how we can deliver to you when you make your order, for instance by specifying an alternative address for delivery or a safe place on your property where we could leave the goods.
Your data
We will use your name, contact details, and any other personal data to fulfill your order, to contact you about your order to keep records to ensure we can respond to any complaints and for business records. If you set up an account with us we will keep your data to ensure we always have your data ready for when you next make an order. If you do not wish for us to hold your data you can use a guest account, and if you already have an account, you can cancel it by emailing us at shop@townmillbakery.com.
We may use third parties, like payment processing companies, to assist us with processing your data but we will ensure they only process your data for the purposes we set out above or for other lawful purposes, and we remain responsible to you for your data. We will always process you data securely and we will ensure that any third parties who process your data on our behalf do so too. We may contact you from time to time by email to tell you about special offers, new products or other marketing. If you would prefer not to receive such marketing you can email us at shop@townmillbakery.com with an email headed “unsubscribe marketing” and we will remove you from the list for future emails.
Right to cancel and complaints
Most of our products are perishable so once we have made the food in your order, we cannot generally accept requests for cancellation. Please contact us for details of cancellation or return of non-perishable goods. If you would like to cancel an order, we may be able to assist if you contact us prior to dispatch. Please contact us at shop@townmillbakery.com if you would like to cancel an order and quote your name, order number, and the date on which you placed your order. We will contact you to confirm whether your order has been cancelled successfully as soon as possible, usually within 24 hours, although this may take longer over weekends or bank holidays.
Our aim is to provide you with outstanding products and service. But if you are unhappy with an order for any reason please contact us as soon as possible with details of your complaint. If we are at fault we will provide you with a full refund, as soon as possible after we have investigated your complaint.
Payment
We currently accept the following payment methods: Visa, Mastercard, Delta, Switch, Maestro & Solo. Prices for our products and deliveries are displayed in GB Pounds and are quoted inclusive of VAT.
Delivery
If you order fresh products or a combination of fresh and not fresh products, before 3pm on a working day, we aim to deliver these on within 2 days after you make your order. If you order is only for products which are not made fresh, we aim to deliver to you within 3 days after you make your order. If the delivery address is very far from our bakery, or if you make an order outside of our normal office hours, delivery may take longer than that – especially if this is over a weekend or bank holiday. Please contact us if you would like to discuss delivery times. Your order will generally be delivered between 9am and 5.30pm on the day you have specified. Unfortunately delivery is not guaranteed for any particular time.
Liability
Nothing in these Terms excludes our liability for death, personal injury, fraudulent misrepresentation or any other liability which may not be excluded by law.
Subject to the limitations of liability in these Terms, we will be responsible for any losses you suffer as a direct result of us breaching these Terms if those losses were reasonably foreseeable to both you and us at the time the contract between us was formed.
We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of third parties acting on our behalf, is consequential or was not reasonably foreseeable to both you and us when the contract between us was formed.
Our liability to you under these Terms will not exceed the total price charged to you for the products comprised in your order.
We will not be responsible to you for any delay or failure to comply with these Terms if the delay or failure arises from any cause beyond our reasonable control.
To the fullest extent permitted by law, we exclude any liability which might otherwise arise by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on our part or any of our employees, directors, agents or otherwise).
While we use reasonable endeavors to ensure that information on this Website is accurate and up to date, we do not warrant its accuracy or completeness and we will not be responsible for any errors or omissions or for the results arising from the use of such information
Miscellaneous Terms
A person who is not a party to these Terms shall have no rights under the Contracts (Rights of Third Parties) Act 1999. Nothing in these Terms is intended nor shall affect any person’s statutory rights that may not be legally excluded.
We may assign or transfer any part of or all our rights or sub contract any part or all of our obligations under these Terms to any third party. You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with our specific written permission.
Our products and this website are offered to customers within mainland UK. If you wish to enquire about making a purchase from elsewhere please contact us and we will be happy to consider your request and provide you with a price for foreign delivery. You will be responsible for delivery charges, import duties, local taxes or other levies, and ensuring that you comply with any applicable local laws relating to your import of our goods. These Terms and your use of our web site are governed by English law and you agree to submit to the jurisdiction of the English courts.
